The Speaker of the Goa Legislative Assembly today passed an order in application filed by Michael Lobo and Digambar Kamat seeking dismissal of the Disqualification Petition filed by Mr, Amit Patkar on the ground that Mr. Amit Patkar not being the member of House/MLA cannot file the Disqualification petition. In the proceeding Mr, Patkar had contended that any interested person can filed Disqualification Petition and relied upon Judgment of the Supreme Court in the matter of Speaker v. Utkal Keshari Parida. The Speaker agreeing with the submission of Mr. Amit Patkar has held that any interested person is entitled to filed Disqualification Petition under Xth schedule of Constitution of India and accordingly, dismissed the application filed by the two MLA’s. The speaker has mentioned that the Matter will be taken on merits now.
