Supreme Court calls upon the Goa Speaker and 8 MLAs to respond to Mr. Girish Chodankar’s Petition directing the Speaker to fulfil its constitutional mandate of deciding disqualification petitions filed against the MLAs guilty of committing constitutional sin of defection.

Mr. Chodankar is well aware of the consequences that entail with the Speaker’s delay in deciding any disqualification petition. His earlier petitions during the 7th Legislative Assembly were derailed and converted into academic issues, due to the Speaker’s delay in deciding his petitions.

In this assembly session, Mr. Chondankar and his timely approach towards the intently and earnestly pursuing disqualification petitions against 8 MLAs who defected from the INC to the BJP within months from election.

Bombay High Court Mr. Chodankar had even approached the Bombay High Court seeking similar directions. Being wary of the fact that

Following the procedure laid down under the law, Mr. Chodankar first approached the High Court and sought directions against the Speaker and 8 defecting MLAs, however with limited relief and directions being granted by the High Court, Mr. Chodankar was persuaded to approach the Hon’ble Supreme Court.

The petition came before the bench of Justice Sanjiv Khanna and Justice S. V. N. Bhatti
