SESSIONS COURT TO HEAR PLEA FOR CANCELLATION OF BAIL TO POONAM PANDEY, HER HUSBAND

MARGAO: An application filed by a resident of Canacona seeking cancellation of bail granted to model and actor Poonam Pandey and her husband Sam Ahmed Bombay will come up for further hearing before the Sessions Court, Margao on Saturday, November 21.

Samrat Bhagat of Nagarsem, Canacona filed an application before the Sessions Court, Margao seeking cancellation of bail granted to Pandey couple by the Judicial Magistrate First Class (JMFC), Canacona.

On Novembe 5, the JMFC, Canacona granted conditional bail to Poonam Pandey and her husband Sam Ahmed after they were arrested by the Canacona police after a vulgar video of the model went viral on social media last week.

Bhagat in his criminal miscellaneous application has stated that the JMFC order was prima facie illegal, perverse and bad in law and that the court erred in holding that the making of a video or a film cannot be outright be termed as obscene or immoral because public say so and there is a public outcry, without actually viewing the said video.

The applicant has stated that plain viewing of the video exposes the prima facie nature of the obscenity and indecency of the said video.

The Canacona police have filed their reply before the Sessions Court.

Both the respondents have contended that the application was devoid of bonafides and makes out no case for cancellation of the bail granted to them. They have appealed to the court to dismiss the application with exemplary cost being abuse of process of law and frivolous.

The Canacona police have already registered a case against Poonam Pandey and her husband under Sections 292, 293 and 294 of IPC and Section 4 read with 6 of the Indecent Representation of Women (Prohibition) Act and Section 67, 67A of the Information Technology (IT) Act.
